I chose Scenario 1 Confidentiality, and the current health policies that I found related to this incident are the Health Insurance Portability and Accountability Act (HIPAA) and the Heath Information Technology for Economic and Clinical Health Act (HITECH). HIPAA is a law that sets standards that help protect patient information from being used without consent. This correlates with this scenario because there is a concern that educational videos contain personal patient information, and it is being shared without their consent. HITECH is a law that sets the proper use of health information technology and protects the concerns related to electronic health records. It is known as an extension to the HIPAA policy. In this case, the electronic records are the videos taken in the ER which patients should be made aware of and have access to.

These policies do meet the current needs of the patient population because no matter how advanced healthcare becomes, every patient deserves to have their information protected. In most facilities, the use of electronic health records is essential as it provides accurate and vital information. A nurse can improve these policies by becoming familiar with its standards so that we are aware if a situation is in violation. They can watch where they view patient information and not access it on personal devices. Nurses can participate in employee training and educate or correct others on the policies. Also, improve the efficiency of care through proper utilization of EHRs.

Sandy is the supervisor of the emergency room and critical care facilities in a large urban teaching hospital that also has a medical school. She was informed by the ER nurses that on weekends several physicians on the faculty of the medical school are setting up closed circuit videotaping of medical students doing admissions histories physical exams and so on in the ER. The tapes are being used for teaching purposes to allow the students and opportunity to evaluate their own mistakes. The physicians assure nursing staff that no one else ever sees the films and that the films help medical students give better medical care.

However, the nursing staff feel they are being coerced into participating in the physical exposure of the clients as well as giving personal information without their consent. The ER nurses appeal to Sandy who intercedes with the physicians and is told that the hospital is a teaching institution and that the films will continue to be taken. If the ER nurses are uncomfortable with the practice, they can refrain from entering the room. But the nurses still know the practices going on.

The supervisor finds that the practice of taking training films on weekends has been going on for several years. The previous nursing supervisor did not find anything objectionable in the practice. The supervisor feels caught between furthering the goals of the medical education and the teaching institution and upholding her nurses’ obligations to protect the privacy and confidentiality of their patients.
